The Structure and Culture of Negotiating Child Victims’ Rights in Cases of Sexual Violence Layyin Mahfiana, Masrukin Masrukin, Diana Zahro, Lukman Santoso Legality Jurnal Ilmiah Hukum, 2026 This article discusses the structure and culture of negotiating children's rights in sexual violence in Surakarta. This study employed a qualitative research method, collecting data through interviews and document analysis. The research writing was structured by data reduction, data presentation, and conclusions. Empirical and legal-philosophical approaches were applied to analyse the data, revealing significant weaknesses that require further attention. The lack of protection, justice, and recovery for child victims remains an issue, which hampers the functions of law enforcers, including the police, the prosecutor's office, and the judicial system. Justice in the system is procedural and formalistic in the context of the burden of proof, overlooking the best interests of the child and leaving child victims without justice and fair access to justice and restitution, while being burdened by procedural formalities. As studied, the majority of people in Surakarta are not fully aware of this matter. Stigmatisation lays the blame on the victims, while inadequate psychosocial support for child victims silences them. Without properly addressing these issues, many children experience discrimination and pressure that only hinders their recovery. This study concludes that to provide the necessary protection for child victims of violence and neglect, different sectoral responses need to be coordinated more effectively. Key recommendations include developing child-sensitive skills among law enforcement officials and other agencies, increasing public understanding of children's rights, simplifying regulations to eliminate duplication, and improving integrated, community-based victim services.
Fragmented Legal Protection in Child Marriage Prevention: Intersections of State Law, Religious Norms, and Local Values in East Java Lukman Santoso, Khaidarulloh Khaidarulloh, Muh Jihad Al Haqiqi Al Ahkam Jurnal Ilmu Syari Ah Dan Hukum, 2026 This article aims to explore the ambiguity in the implementation of policies to prevent child marriage in East Java. Although Law No. 16 of 2019 has raised the minimum age for marriage, the number of requests for marriage dispensations remains high. This legal research uses a socio-legal approach and normative-empirical analysis of the discourse on preventing child marriage in East Java. Using Clifford Geertz's broker-culture theory, this study captures how religious elites and local figures act as cultural brokers who bridge and transform the meaning of national legal norms into the value framework of local communities. Boaventura de Sousa Santos' theory of interlegality helps map the overlap between state law, religious law, and customary norms that form a hybrid legal structure in the practice of granting marriage dispensations. This study finds that the misalignment between national law, local norms, and socio-religious authorities has led to fragmented legal protection for children. This situation is exacerbated by the absence of effective binding local regulations and the state's weak capacity to intervene in religious discourse and social practices surrounding child marriage. This study contributes to an inclusive-collaborative approach to preventing child marriage through a framework of legal glocalisation, namely: proactive policies, integrated empowerment, and equal multi-stakeholder synergy, including local governments, the Ministry of Religious Affairs, health workers, peer counsellors, families, civil society, the Indonesian Ulema Council (MUI), and religious leaders.
Challenging Legal Injustice against Children in Incest Cases: A Progressive and Islamic Human Rights Approach Lukman Santoso, Ulvi Rohmatul Musyayyadah De Jure Jurnal Hukum Dan Syar Iah, 2025 Illegitimate children born from incest present complex issues in civil law, particularly concerning their legal status and the protection of their rights. The main legal problem concerns the position of the biological father. Under Islamic law, the biological father has no legal relationship of lineage, guardianship, or inheritance with the child. However, from a moral, constitutional, and human rights perspective, the father still bears responsibility for fulfilling the child’s basic rights. This study examines the legal consequences and obligations of biological fathers toward illegitimate children using the perspectives of Progressive Law and Islamic Human Rights. The research employs a normative legal method, focusing on Article 283 of the Civil Code, which prohibits the recognition of illegitimate children. This provision is analyzed in relation to the Child Protection Law, the Human Rights Law, the International Covenant on Civil and Political Rights, and other relevant regulations. In addition, conceptual and philosophical approaches are used to reinterpret rigid legal norms by emphasizing justice, humanity, and social reality. The study finds that recognition of illegitimate children by their biological fathers may be permitted to the extent that it ensures the fulfillment of the child’s fundamental rights, such as financial support, education, and health care. However, recognition should not extend to lineage, inheritance, or guardianship, in order to uphold the principle of hifz al-nasl (protection of lineage). These limitations are not discriminatory but aim to harmonize child protection with the principles of Islamic law. Furthermore, responsibility for protecting children does not rest solely on parents; the state and society also have a duty to ensure that all children receive equal protection. This research offers a legal reconstruction that bridges Islamic law and human rights, providing a normative basis for child protection policies consistent with maqāṣid al-sharīʿah.
Legal Politics of Mining Spatial Planning in Indonesia: Maqās}id Syarī’ah Overview Muhammad Shohibul Itmam, Sirajul Munir, Lukman Santoso, Taufikin, Abdelmalek Aouich Ijtihad Jurnal Wacana Hukum Islam Dan Kemanusiaan, 2025 This research aimed to show the dynamics of mining spatial planning law in Sumenep Regency, Madura, Indonesia and the relevance to Maqāṣid Syarī'ah as a pillar of Islamic law. In this context, qualitative analysis was used by collecting data through observation, interviews, and document review. The results showed that phosphate mining regulations in Sumenep Regency reflected sensitive dynamics using political law theory as an analytical tool and a socio-legal method, where economic interests, environmental sustainability, and community aspirations were in conflict. Additionally, legal politics in the formulation of Regional Regulations (Perda) based on maqâṣid achieved a balanced utilization of natural resources with respect to the protection of nature and humanity. In Islamic law, this perspective is consistent with the principles of rahmatan lil-'ālamīn and 'imārah al-arḍ since humans are stewards of the earth. This study makes an important academic contribution by integrating the principles of maqāṣid syarī‘ah into the analysis of mining spatial planning law at the local level. The findings of this study indicate that the formulation of regional regulations based on maqāṣid not only enables the protection of the environment and community rights but also strengthens the role of Islamic law as an ethical instrument in the equitable and sustainable management of natural resources.
Interpreting Legal Rights: Disparities in Judicial Treatment of Children Born Out of Wedlock in East Java, Indonesia Lia Noviana, Lukman Santoso, Mega Puspita Lex Scientia Law Review, 2024 The status of illegitimate children or children out of wedlock is a complex and sensitive issue that attracts attention in the Indonesian legal system. Although it has been regulated in various regulations and there is a Constitutional Court Decision Number 46/PUU-VIII/2010, implementing the protection of the legal rights of children outside marriage in different judges' decisions still experiences disparities. This article aims to analyze the differences in interpretation related to the status of children outside marriage in the judicial environment in East Java, as well as how to formulate the ideal protection of the group and civil rights of children outside marriage. This research is a non-doctrinal research using conceptual and philosophical approaches. This study found complexities in considering children's best interests in court decisions. Some judges seek to ensure the protection and rights of children born out of wedlock, while others think about social stability and religious norms. The ideal reformulation of the legal status of children born out of wedlock requires a comprehensive dialogue approach and more inclusive legal reforms. Recommendations are also made to strengthen more explicit legal guidelines for judges in dealing with such cases, considering the child's legal, religious, and best interests. This research contributes to efforts to realize ideal legal protection for out-of-wedlock children and anticipate evolving legal problems.
HALAL REGULATION AND CERTIFICATION IN THE CATERING BUSINESS: A Critical Review of Consumer Protection Rohmah Maulidia, Khusniati Rofi'ah, Lukman Santoso Jurisdictie Jurnal Hukum Dan Syariah, 2024 Halal certification in catering businesses still faces various regulatory and implementation problems, which impact the lack of consumer protection rights. This article explores the implications of halal regulation and certification in the catering business for consumer protection and how the catering business sector is ready to respond to halal certification. The research method used is juridical sociological research, with an empirical approach and critical analysis of relevant literature, including legal regulations and halal certification standards, as well as case studies of catering business practices in Ponorogo. The results show that proper understanding and implementation of halal regulations and certification contribute significantly to consumer protection by creating trust, ensuring information transparency, and improving the quality and safety of the food provided. This research provides a deep insight into the relationship between halal regulation and consumer protection in the context of the catering business. It highlights the importance of legal awareness and appropriate practices for business actors, thereby supporting the success of halal certification programs in the food business sector, including catering.Sertifikasi halal pada usaha catering masih menghadapi beragam problem regulasi dan implementasi, sehingga berdampak pada minimnya hak perlindungan bagi konsumen. Artikel ini bertujuan untuk mengeksplorasi implikasi regulasi dan sertifikasi halal dalam bisnis katering terhadap perlindungan konsumen serta bagaimana kesiapan sektor usaha katering dalam menyikapi sertifikasi halal tersebut. Metode penelitian yang digunakan adalah penelitian yuridis sosiologis, dengan pendekatan empiris dan analisis kritis terhadap literatur yang relevan, termasuk peraturan hukum dan standar sertifikasi halal, serta studi kasus dari praktek bisnis katering di Ponorogo. Hasil penelitian menunjukkan bahwa pemahaman dan implementasi yang tepat terhadap regulasi dan sertifikasi halal berkontribusi secara signifikan terhadap perlindungan konsumen, dengan menciptakan kepercayaan, memastikan transparansi informasi, dan meningkatkan kualitas serta keamanan makanan yang disediakan. Kontribusi penelitian ini adalah memberikan wawasan yang mendalam tentang hubungan antara regulasi halal dan perlindungan konsumen dalam konteks bisnis katering, serta menyoroti pentingnya kesadaran hukum dan praktik yang sesuai bagi para pelaku bisnis. Sehingga menunjang keberhasilan program sertifikasi halal pada sektor bisnis makanan, termasuk katering.
Tradition, Wisdom and Negotiating Marriage and Inheritance Disputes on Javanese Muslim Miftahul Huda, Agus Purnomo, Abdul Mun'im, Lutfi Hadi Aminuddin, Lukman Santoso Al Istinbath Jurnal Hukum Islam, 2024 This study aims to find a negotiation model in the tradition of Javanese Muslim communities in resolving disputes regarding marriage and inheritance restrictions. When the reality of resolving marriage and inheritance disputes impacts family and community strife, this becomes crucial. The qualitative paradigm was used to construct this research, which included a series of observations and in-depth interviews with the disputed families and focus group discussions with informants in the East Java community. This research discovers three models for resolving the tradition of avoiding marriage and inheritance disputes in Javanese Muslim society with social components in a heterogeneous society. 1) negotiating the traditional cum theology model, 2) negotiating the tradition and law model, and 3) negotiating the traditional wisdom model. Furthermore, when many cultural traditions fade, the growing negotiation model can serve as the foundation for policy for local governments in generating variants of the nation's cultural traditions.
REFUSAL OF POLYGAMY PERMIT IN RELIGIOUS COURT DECISION: Criticism of Gender Justice Against Judge’s Legal Reasoning Lukman Santoso, Arij Amaliyah, Miftahul Huda Al Risalah Forum Kajian Hukum Dan Sosial Kemasyarakatan, 2023 This study aims to determine and analyse the judges' considerations using gender justice in the Decision of the Madiun District Religious Court Number 1512/Pdt.G/2022/PA.Kab.Mn. Normatively, the permissibility of polygamy rests on the wife's consent and the husband's ability to be fair. In this case, the problem started with applying for a polygamy permit after the Applicant married his second wife. Argumentation: The Applicant, who was married before applying polygamy, was considered unlawful. This is doctrinal legal research with a case, conceptual, and statutory approach. Data sources for this research are court decisions, laws and regulations, books, journals, and research results. This research provides a conceptual basis for judges in making decisions on applications for polygamy licenses based on gender equity so that justice in society is created objectively.
Utilitarianism In Halal Tourism Development In Indonesia Lukman Santoso, Soleh Hasan Wahid Mazahib Jurnal Pemikiran Hukum Islam, 2023 Halal tourism is one of the fastest-growing areas in the world economy. As a Muslim-majority country, Indonesia has the potential to promote halal tourism. However, there are still many problems in the development of halal tourism to realize sustainable benefits and the welfare of the people. This study aims to explore the development of halal tourism in Indonesia from a helpful philosophical perspective. By using a qualitative-interpretative approach, this study employed a library research method. This study provides findings that the development of halal tourism in Indonesia has not given the maximum benefit and welfare impact. Therefore, in the future, in formulating tourism development policies, it is essential to prioritize integrative and responsive aspects by involving all stakeholders and aligning them with the sustainable national development framework. The contribution of this study seeks to present regulatory formulations that have a positive impact on many people and rely on rule utilitarianism. Thus, it will give birth to a halal tourism policy that is inclusive, humane, and contextual to national and global dynamics.
DIGITALISING HALAL CERTIFICATION: The Dynamic of Regulations and Policies Concerning Halal Certification in Indonesia Lukman Santoso, Abdul Rachman Jurisdictie Jurnal Hukum Dan Syariah, 2023 The global halal product market is proliferating, fuelling increased demand for quality halal products. To fulfil halal certification requirements, Micro, Small and Medium Enterprises (MSMEs) in East Java Province, Indonesia face challenges in the certification process which is manual, time-consuming and inefficient. To overcome these problems, this study aims to explore the urgency of digitalising halal certification for optimal impact on improving the quality of halal products for MSMEs in East Java. This research employed a qualitative
 method with a literature and conceptual juridical approach. This research used primary and secondary data, namely BPJPH data, the Office of Cooperatives and SMEs of East Java Province. The results of this study indicate that government regulations and policies related to halal certification provide legal certainty for digital transformation in the implementation of halal certification in East Java Province. Although the achievements of MSMEs in East Java Province are low compared to those of other provinces, the digitalisation of halal certification can effectively help the MSMEs in East Java Province to reduce costs, expedite halal certification processing time, and increase compliance with halal requirements so that acceleration and increase in the number of halal certifications for MSMEs can take place properly.
 
 Pasar produk halal global terus berkembang dengan pesat dan mendorong peningkatan permintaan terhadap produk halal yang berkualitas. Untuk memenuhi persyaratan sertifikasi halal, Usaha Mikro, Kecil, dan Menengah (UMKM) di Provinsi Jawa Timur, Indonesia menghadapi tantangan dalam proses sertifikasi yang manual, memakan waktu, dan kurang efisien. Untuk mengatasi masalah tersebut, penelitian ini bertujuan mengeksplorasi urgensi digitalisasi sertifikasi halal sehingga berdampak optimal terhadap peningkatan kualitas produk halal UMKM di Jawa Timur. Metode penelitian yang digunakan adalah penelitian kualitatif dengan pendekatan netnografi dan yuridis konseptual. Penelitian ini menggunakan data hasil wawancara dengan pegiat sertifikasi halal dan data dari situs BPJPH, Dinas Koperasi dan UKM Provinsi Jawa Timur. Hasil penelitian ini menunjukkan bahwa regulasi dan kebijakan pemerintah terkait sertifikasi halal memberikan kepastian hukum terhadap transformasi digital dalam pelaksanaan sertifikasi halal di Provinsi Jawa Timur. Walaupun capaian pelaku UMKM di Provinsi Jawa Timur tergolong rendah dibandingkan dengan provinsi lainnya, namun digitalisasi sertifikasi halal efektif dapat membantu UMKM Provinsi Jawa Timur untuk mengurangi biaya, mempercepat waktu sertifikasi halal, dan meningkatkan kepatuhan terhadap persyaratan halal sehingga percepatan dan peningkatan jumlah sertifikasi halal bagi UMKM dapat terlaksana dengan baik.
