Intellectual Property Rights: Theoretical Foundations to Practical Considerations Rajni Malhotra Dhingra, Nisha Dhanraj Dewani Intellectual Property Rights and Competition Law in India, 2024 The transition from theoretical foundations to the practical execution of rights and intellectual property rights (IPR) have undergone dynamic and intricate development, guided by significant principles such as laissez-faire, the theory of labor desert, personhood, and TRIPs. The theoretical underpinnings of intellectual property rights (IPR) were established on ancient legal traditions and concepts of ownership, transfer of ownership, and government safeguards. These national and international frameworks laid the groundwork for acknowledging and safeguarding intellectual contributions, emphasizing a delicate balance between granting exclusive rights to creators and promoting public accessibility. However, it raises various issues regarding the acceptability of adaptability accompanying new amendments or updated laws. The question arises: How long can domestic laws implement these theories and international laws? This chapter analyzes the influential impact of significant legislation accepting IPR as a means to facilitate trade freely. Moreover, it explores the challenges presented by the digital era, addressing issues such as Internet piracy and the intricate balance between safeguarding the author’s right with public interest doctrine. Additionally, practical issues concerning theories of IPR are examined in light of new laws. Recognizing the intricate balance required to safeguard both individual liberties and creators’ rights, the analysis considers the impact on freedom of expression, access to knowledge, and innovation. Through a comprehensive review of legal frameworks, landmark cases, and international perspectives, this research aims to shed light on the nuanced dynamics between rights and intellectual property.

Rapid and inclusive green growth is the only answer for all these problems especially for those who are at the bottom of the economic pyramid. Many efforts have been taken at the national and international level to achieve the objective but till date, the divide between rich and poor has not been reduced much due to uncontrolled greed of few person. The objective of the study is to highlight the initiative taken by the government, analyse the success rate and to find out why the initiative taken by the government to ensure dignified healthy existence are not able to get the expected success. The research will be primarily analytical and doctrinal. The reports of various agencies (governmental and non-governmental) will be analysed to find out the reason of slow progress.
