  • Reconstructing Marriage Annulment in Dui’ Pappenre within Bugis Customary Law

    This article explores the intersection of national law and Bugis customary tradition through Dui’ Pappenre in marriage annulment cases. Using a normative legal approach, it identifies a legal vacuum: while Dui’ Pappenre symbolizes respect and social standing in Bugis culture, it remains unrecognized in both the Marriage Law and the Compilation of Islamic Law, creating legal uncertainty and inconsistent rulings. Misinterpreted as a mandatory dowry, Dui’ Pappenre often places disproportionate social and economic burdens, reinforcing gender and class inequalities. The lack of legal clarity not only marginalizes cultural values but also exemplifies broader challenges of legal pluralism in Indonesia’s multicultural society. The study advocates for reform that explicitly distinguishes Dui’ Pappenre from dowry, provides judges with cultural training, and promotes public education to counter misconceptions. These recommendations contribute to global debates on harmonizing customary practices with modern legal frameworks while ensuring cultural preservation and substantive justice.
  • Intersectionality in Social Justice: Unpacking the Complexity of Oppression

    This study aims to understand, explain, and address the complexities of oppression in a multicultural and multiethnic society such as ASEAN. This study uses a law-based methodological approach that integrates intersectionality, postcolonial, feminist, critical race, and queer theories concerning international legal instruments. Based on the results of the study, mapping the landscape of intersectionality in ASEAN reveals how the interaction of gender, race, class, religion, and sexual orientation creates multiple discriminations, such as those experienced by female migrant workers, the LGBTQ+ community, and religious and ethnic minorities, who are often marginalised in legal systems and public policies. While international instruments demand protection without discrimination, inconsistent implementation of laws in ASEAN exacerbates existing structural injustices. Therefore, a transformative strategy for social justice in ASEAN requires a rights-based approach that focuses on empowering vulnerable groups, their active participation in decision-making processes, and legal reforms that integrate principles of intersectionality to ensure equitable access to justice. This approach can only succeed if ASEAN countries align domestic policies with international standards, strengthen inclusive legal systems, and empower regional mechanisms such as the ASEAN Intergovernmental Commission on Human Rights (AICHR) to more effectively uphold human rights in the region.
  • LEGAL PROTECTION OF YEI PEOPLE'S KNOWLEDGE OF LOCAL MEDICINES AND MEDICINAL PLANTS FROM EXTINCTION

    Food security investments have brought conflict between local indigenous communities and the government in South Papua. The research aims to encourage protection and recognition efforts from the state towards indigenous peoples' entities. This research uses socio-legal studies. The research found sixteen plants that function as medicine. Inventory in the form of "recording" communal intellectual property is the first step to protecting all communal intellectual property that has never been recorded before. The Yei Indigenous People or the local government should work together to register with the Ministry to obtain rights to communal intellectual property, which will impact state action in protecting and defending communal intellectual property rights.
  • A Comparative Research on the Effectiveness of Progressive versus Proportional Tax Systems in Enhancing Social Justice

    This research investigates the effectiveness of progressive and proportional tax systems in promoting social justice from the perspectives of tax law and accounting. Each system presents its own advantages and disadvantages. While progressive taxation is considered more vertically equitable, it may induce economic distortions—inefficiencies that disrupt market dynamics and prevent economic agents from maximizing social welfare. In contrast, proportional taxes are simpler and more efficient but are less equitable in their distribution of the tax burden. This study identifies critical challenges, including weak law enforcement characterized by inconsistent application of laws and a tendency for those in power to evade accountability, as well as low taxpayer compliance and discrepancies between tax law and accounting standards. To achieve optimal social justice, this research advocates for a hybrid approach that integrates elements from both tax systems, harmonizes regulations, and enhances taxpayer compliance through improved law enforcement and public education initiatives.
