Tamar pitch. difference, differences, and fundamental rights Ilaria Boiano Legal Feminism Italian Theories and Perspectives, 2022 This chapter reconstructs Tamar Pitch’s rich theoretical elaboration starting from the concept of ‘sexual difference’, used by the philosopher and sociologist of law to question the legal subject, law, rights, and freedom, put to the test by cultural differences and social inequalities. The chapter also illustrates the work devoted by the scholar to the processes and products of social control, conformity induction, and deviance construction, as Tamar Pitch was the first to explore these areas from a feminist perspective. The chapter closes with a focus on the interpretation of legal feminism as developed by the scholar.
Citizenship/borders Ilaria Boiano Legal Feminism Italian Theories and Perspectives, 2022 This chapter explores feminist reflections on citizenship as a marker of belonging, problematising the concept in light of the decline of state sovereignty and the paradoxical reconstruction of borders and the erection of new walls. The concept of citizenship will therefore be read together with that of border, a term understood in a distinct way from the concept of boundary, because it recalls a space of transition in which one may enter into relationship.
Lia cigarini and the freedom of the 'Legislative Void' Ilaria Boiano, Angela Condello Legal Feminism Italian Theories and Perspectives, 2022 This chapter outlines the work of Lia Cigarini, lawyer and feminist thinker, tracing her political practice, her work as a lawyer, and her theoretical production developed in line with Italian feminism of difference, intended as a movement of thoughts, bodies, and political discourses in which normative and descriptive fields intersect. The analysis of Lia Cigarini’s intellectual production revolves around a series of keywords that over time have opened up the semantic field of legal feminism: experience, separation, self-consciousness, desire, power, body, signification, authority, symbolic order, mother. These words not only constitute the fundamental vocabulary of feminism of sexual difference, but are also presented as possible keys to interpreting the relationship between law, rights, and female freedom.
Italian legal feminism - engaging with the power of law Ilaria Boiano Contesting Femicide Feminism and the Power of Law Revisited, 2018 Carol Smart's Feminism and the Power of Law has been a key reference for Italian feminist critiques of law. Indeed, her critique of how law is gendered remains a pillar around which Italian feminism continues to question law. This chapter retraces the trajectories of Smart's influence with reference to differences of opinion within Italian legal feminism and feminist legal practice. When Sylviane Colombo introduced the term 'legal feminism' to Italian feminists in 1992 she described it as a set of critical perspectives on law produced by feminist scholars in the context of Anglo-American academia. Italy has witnessed a continuous process of legal reforms relating to intimate partner violence. While 'femicide' refers to the killing of a woman because she is a woman, 'feminicide' refers to the general context of gender-based discrimination and violence against women, including practices of public authorities that contribute to a culture of domination by allowing men to commit violent acts with impunity.
